Mojito Beach HOA
Villas Bylaws and Community Rules
Effective Date: October 15, 2025
1. Villas

Architectural Approval
All architectural plans for new homes must be submitted to the HOA Architectural Review Committee for approval. Plans should be emailed to
[email protected].
Reviews will generally be completed within three business days. -
Design Standards
All homes must follow a modern architectural design theme. -
Construction Deadline
All homes, including landscaping, must be completed by September 2030. If construction is not completed within five years of receiving environmental approval, the owner must obtain new approval and will be subject to a $30,000 fine. -
Minimum Building Footprint
Each home must have a minimum building footprint of 1,400 square feet. -
Exterior Colors and Finishes
Home colors, paint, trim, and exterior finishes must comply with the community’s established standards. -
Insurance Requirements
Property and vehicle insurance must be maintained at all times. -
Privacy Vegetation
Owners must plant and maintain natural vegetation between villas to help preserve privacy. -
Lot Subdivision
Subdividing lots is prohibited. -
Streets and Property Boundaries
Altering streets or property boundaries is prohibited. -
Property Modifications
Written approval from the HOA is required before making any modification to an owner’s property. -
Exterior Maintenance
Villa exteriors and all construction must be maintained in good condition. -
Private Installations
Owners are responsible for maintaining their villas and all private installations in safe and proper working order. -
Vacant-Lot Maintenance
Until construction begins, owners must trim and maintain vegetation on their property at least once per month. If the HOA must perform this work, additional fees will apply. -
Vehicles on Unconstructed Property
Campers and vehicles may not be parked or stored on any property unless the property is under active construction.

2. Owners
- Owners must treat community property and common areas with care and report any damage or maintenance concerns to the appropriate parties.
- Villas are designated for single-family residential use unless written authorization for another use has been obtained.
- Owners must not allow weeds, trash, debris, or other unsightly materials to accumulate on their property or in community green zones.
- Owners may access all common areas unless access is otherwise restricted by HOA Administration.
- Owners are responsible for any damage caused by themselves, their family members, employees, contractors, guests, tenants, or visitors within Mojito Beach.
- All employees, contractors, and other staff working for property owners must present valid identification to Mojito Beach Administration before entering the community.
3. Renters
- All renters registered to a villa are jointly responsible for complying with HOA rules and for any damages caused during their occupancy.
- Renters who damage common areas will be fined. Payment will be due immediately in the amount determined by the HOA.
- Mojito Beach is the community developer. Rental villas are independently owned and managed by individual homeowners or companies. The HOA is not responsible for maintenance, management, or tenant-related issues involving privately owned villas.
4. Visitors to Rental Villas
- Visitors may not drive into Mojito Beach unless accompanied by the registered renter.
- Visitor parking is limited to one vehicle per villa after 10:00 p.m. on weekdays and after 11:00 p.m. on weekends.
- Additional visitors and special events require advance approval from HOA Administration. The HOA reserves the right to limit the number of attendees.
- Visitors must remain with their registered host and may not wander through the community unaccompanied.
- Large gatherings at community entrances are prohibited.
- Visitors must comply with all HOA and security rules, including any additional instructions provided by HOA or security personnel.
5. Minors
- All minors must be accompanied by a parent or legal guardian and registered at the front desk. This requirement also applies to visiting minors.
6. Driving and Parking
- The community speed limit is 30 kilometers per hour (18 miles per hour).
- Drivers must lower their vehicle windows at security gates when requested for identification.

Parking is limited as follows:
- One vehicle on a single parking pad
- Two vehicles on a double parking pad
- Three vehicles in a circular parking area
Excess vehicles must use guest parking or another designated parking area.
- Trailers may not be parked, placed, or installed within the community, even temporarily.
- Parking on streets or in green zones is prohibited.
- Campers and vehicles may not be parked or stored on properties that are not under active construction.
7. Animals and Pets
- No animal may be kept within Mojito Beach without prior written permission from HOA Administration.
- A maximum of two domestic pets is permitted per home.
- Owners and tenants must immediately clean up after their pets.
- Pets must be kept on a leash while in common areas.
8. Noise and Conduct
- Mojito Beach is a residential community. Residents, tenants, and visitors are expected to respect their neighbors and maintain appropriate conduct.

The following enforcement process may apply to disturbances or rule violations:
- A verbal warning
- A written warning
- HOA involvement of law enforcement or removal of the offending individual if the behavior continues
The property owner may be fined $100, and offending renters or visitors may be blacklisted from the community.

Rental tenants who receive repeated after-hours noise complaints may lose gate-access privileges. After-hours periods begin at:
- 10:00 p.m. on weekdays
- 11:00 p.m. on weekends

Music is permitted at reasonable volume levels during the following hours:
- Weekdays: 9:00 a.m. to 10:00 p.m.
- Weekends: 9:00 a.m. to 11:00 p.m.
- There is zero tolerance for loud noise or profanity after permitted hours. Karaoke is prohibited at all times.
- Residents, tenants, and visitors must maintain peace, courtesy, and respectful behavior at all times.

9. Garbage
- Garbage cans must be kept in designated locations, secured with lids, and stored out of public view.
- Bulk garbage and yard waste must remain on the owner’s property until the scheduled collection date.
10. Fences and Walls
- No fence or wall may be constructed without express written permission from HOA Administration.
11. Home Businesses
- Operating any business from a villa requires prior written approval from HOA Administration.
12. Firearms, Illegal Drugs, and Narcotics
- Firearms, illegal drugs, and narcotics are strictly prohibited anywhere within Mojito Beach.
13. Drones
- Drones may not be operated within Mojito Beach without prior written authorization from the HOA.
14. Miscellaneous Rules
- Signage of any kind is prohibited.
- Satellite dishes and antennas may not be visible from roads or neighboring properties.
- Electric generators are prohibited. Solar panels require prior written approval from HOA Administration.
- Clothing or other items may not be hung or placed outside to dry where they are visible to others.
- The storage of flammable, explosive, hazardous, or unhealthy materials is prohibited, except for propane gas stored and used in an approved manner.
15. HOA Fees

HOA fees are charged as follows:
- Before construction is completed: $99 per month, per lot
- After construction is completed: $199 per month, per home
Fees may be adjusted based on the community’s operational and maintenance needs.
- If HOA fees become more than 60 days overdue, gate access will be suspended until the outstanding balance is paid.
- Owners must acknowledge receipt of all written HOA notices within five business days.

16. Fines and Enforcement
- Violations of these bylaws or community rules may result in fines in amounts determined by HOA Administration.
- The HOA may contact or involve law enforcement when necessary to address illegal, dangerous, or inappropriate conduct.
- These rules are intended to protect property values, promote community safety, and maintain a pleasant living environment for all residents, owners, tenants, and visitors.
Important: These bylaws and community rules may be amended or supplemented by Mojito Beach HOA Administration as permitted by the governing documents and applicable law.
